Terms of Service Agreement:
Windy City Drones grants the client a limited, non-exclusive, non-transferable license for listing the property under the client’s current contract with the property owner. This extends to the client’s use of images on the MLS listing as well as other promotional materials intended to sell the property. In the event the property does not sell, these images may not be transferred to any other party, including subsequent listing agents or the property owner. The client may use the images for self promotion. Ownership of the images remains with Windy City Drones, and license is granted only to the Client and Client’s parent company, and not to any third party. Any usage of the images by a third party, including but not limited to, architects, builders, stagers, designers, sellers or buyers, is strictly prohibited unless approved in writing by Windy City Drones.
Payment is due when or before services are rendered. If payment is not received within thirty (30) business days of the initial invoice, client agrees that service provider may charge a late fee equal to 3% of the outstanding balance per month thereafter. The client will not be able to order additional services and any associated photo links will be disabled until they pay the entire balance due. If the client’s tour is disabled for non-payment, a $15 re-activation fee will be added to the client’s account, but the photographs will not be re-activated until the entire balance is paid. Buyer understands and agrees that if upon 90 days, the invoice remains unpaid Service Provider may turn over the account to a third-party collection agency.
If the photographer cannot shoot the property once they arrive due to reasons beyond our control (ex: unable to gain access to the property, excessive clutter, unrestrained animals) you will be charged the full fee of the shoot. Please review the home preparation guide and make sure certain arrangements have been made to access the property prior to scheduling a shoot.
It is the Realtor and/or home owner’s responsibility to have the home in photo ready condition prior to the photographer arriving. The photographer may make minor adjustments to improve the shot, but they cannot move furniture or make significant changes, clean the home, etc. Be sure to read our home preparation guide several days prior to your shoot to make sure you are ready to capture the best photos possible. All properties will be shot “as is”.
If, for any reason, you are unable to keep your scheduled appointment please provide 48 hours’ notice so we can reschedule you at a more appropriate time. Cancellations with less than 48 hours’ notice may incur a $25 cancellation fee.
Please make special requests known to the photographer before the shoot begins. This includes specific shots, angles and highlights. If no special requests are received, the photographer will shoot the home based on experience, the home’s condition, lighting and several other factors to get the best possible shots.
Turnaround time for photography is (2) business days. Although you may get your photos back in less time we cannot guarantee it. If you have a situation that requires a quicker turnaround time we offer a (24) hour express service for additional fee. Please contact us for more information.
In the case of inclement weather conditions, we will provide (1) exterior blue sky replacement photo free of charge. Additional exterior blue sky replacement photos can be added, or a reshoot can be scheduled for a small fee.
